View Full Version : Vacation Pay policy changes reducing past accruals North Carolina

I have worked for a company for over 11 years. I am still there, however, in the past 3 years we have had as many "presidents" of the company, including a lot of changes and sacrifices (no raise in almost 2 years, no bonus). The company has now implemented a vacation/sick pay policy change. They decided to notify us of the change on 1/3/08 saying it was "effective immediately". The change affects my paycheck that I received on Friday, 1/4/08 (paid biweekly) which is for the pay period December 23 - January 4th. Doesn't this basically make the change effective December 23 and if they are decreasing the amount of vacation time I accrue during these PAST 2 weeks didn't they have to notify me PRIOR to the reduction?
Is it legal for them to do this or do they have to start the changes and reduced the accruals AS of the DATE OF NOTIFICATION (which would make the earliest possible effective date 1/3/08) and then not reflected until my January 18th paycheck??
Please advise. I know this will only gain me the 6.67 hour accrual that I would have received for this one pay period, and it isn't so much about the 6.67 hours, as it is about the fact that they changed it without even notifying us about it.

How is this affecting your current paycheck?

The law generally prohibits a decrease in pay for hours already worked, not pay for nonworked hours.
