hi,

I had filed for an H1B visa and I had filed an contract of 1 year with the consulting company in New jersey. As per the agreement if i leave the company within an year i will have to pay 15k USD to them. I had to leave this organisation as the salary they were paying me was too low and was not at all affordable in California. I requested them to increase the salary but all i got was false promises. Now the company has filed a law suit against me. Do i have any chance of winning the case or atleast reducing the amount?
This is a New jersey based company so i have to go to New Jersey to fight for the case. The company has done many wrong doings like taking the paper which they had given when i came to US.Making us sign some other document. Changing the resume, etc. Posing as a big company with XXX employees , showing wrong projects. There are many ex employees of the company who have left the organisation and who have the same plight. Also if i want to go in labor law against the organisation what are the steps needed.

Help needed urgently

If you're being sued, you need more help than can be provided on a board like this one. You need your own attorney.

If you are being paid the amount specified in the H1b petition, they are not obligated to pay you more. Not getting a raise is not going to be just cause to quit and not owe the money promised. The time to discuss your options with a lawyer is before you quit. Now you are into damage control.

The other issues may or may not be proper but they will have no bearing on whether or not you owe the money.

Agree that you need a lawyer ASAP.
