Scenario: An hourly employee is required to travel out of state and works Mon-Fri from 7:00AM-3:30PM....the employee has put in a 40 hour work week; however, the employee also has 8 hours (roundtrip) of travel time to and from the job site. Would 8 hours of travel time be required to be paid as overtime. Please advise. Thanks.

Many times employees may travel from their home say in Lawrenceville, Ga to their job site location of Hilton Head, SC and then back to Lawrenceville, Ga or several may meet at the office in Atlanta, Ga, ride together in a company vehicle and go to Hilton Head together and travel back to the Atlanta office. It varies, the employee may leave from their home and return to their home or they may leave from the office and return to the office if many are riding together. Does that help clarify?

Here are the FLSA regulations regarding travel for nonexempt employees. It makes a difference if 1) the travel involves an overnight stay vs a 1-day assignment; 2) the individual is a passenger or a driver and/or; 3) it is an "emergency" situation.
