View Full Version : Getting Evicted for Paying Rent Late and Lease Violations Illinois

Hi -

I just recieved a notice about and "unconditional quit notice" from my landlord. The reason for eviction states that I have

1. Didn't adhere to the terms of my lease and I'm in violation of the agreement. - but it doesn't state in which way I'm in violation.

2. Failure to pay rent in a timely manner - althought she's been accepting late rent payements from me since I've been unemployed.

I am now recently employed now 2 weeks. I wrote her a letter explaining that I wouldn't have a problem paying the rent as long as she fixed several things that was wrong with the apartment - the sewage back up in the kitchen, the heat - which I have already had fixed myself as of Dec 1. She took 2 weeks to repair the refrigerator in which I had lost a lot of food. Being that I was unemployed at the time hurt me since I didn't get state food assistance and had to eat out and re-purchase more food.

In my previous lease, it states that I can pay rent late which I have a right to. It doesn't state how late in the month as long as during the month I pay the rent with the late fee.

What are my rights in Illinois?:mad:

You have the right to move before eviction process starts. If you let this go to court it will be more difficult to find new housing. Paying rent late is a violation of lease terms. Landlord accepting late payments does not change that.

Thanks, but I read something here on the internet that if she had been acceptting late payments then she can not evict me for that since she's been accepting it all this time.

So you're saying that's not true?

I am cannot say thats fact or not but lease terms state rent is paid by (insert date) if you fail to pay on time thats violation of lease terms.

I'm reviewing over my lease and it doesn't state that in words. It does state that is rent is not paid withing 5 days of rent due date that a late fee is accessed of $50.

I guess I would also like a reponse from an attorney as to my questions.

Then you should call one as there are few Attorneys here and those that are her emay not work on tenant/landlord issues and may not work in your state
