Hello All--
I know this has been addressed before, but I am just poking around for information. Is there any limit to the number of hours an employer can require for mandatory overtime? The employer is currently requiring one employee to work 96 hours per 7 day week. No days off. This has been the scenario for about 6 weeks. The employer in question is a Private Security Company and the employee is an unarmed mall parking lot security guard.

Thanks for any advice or help. This question is for my fiance. The poor man can barely stand or eat at night they have him working so much. He has not had a day off in six weeks. The employer says this is required. There are others to fill his time, but the supervisor says these people are not trustworthy.

What is the maximum limit for overtime in North Carolina? How far can they push it legally before you can decline without fear of punishment?

The maximum number of hours you can be required to work in NC (and in most other states) is 168 (24 x 7).

There are only two states that limit the amount of overtime you can be required to work, and NC is neither of them.

There is no point at which you are guaranteed protection if you decline to work overtime. You can be fired for declining overtime no matter how much it is.

I think it's unfair too, but until some enlightened future president sees fit to appoint me Labor Secretary, that's the way it is.
