I am an owner/employer of a company in NC. I have recently found out through security tapes and register tapes that two employees of mine have been embezzling money for the last three months in excess of 11,000.00, my question is, I am going to be pressing charges againest these two employees. Am I able to hold their last paycheck until this process is completed seeing they have already stolen so much from me already? :mad: Or do I have no other choice but to give them their paycheck (especially the one who has already said he was leaving town because he was caught) and just let them go and hope that the judicial system works it all out (which most know will probably never happen :( )

Legally, you must pay them. I fully understand why you don't want to and it's just barely possible that you might get away with not doing so if you're very, very lucky. But the law makes no provision for not paying an employee who has stolen from you.

The court can order restitution so you may be repayed
