View Full Version : Tenant Rights for Eviction during Winter in IL Illinois

I live in IL and wanted to know if there is a Law in IL stating that a tenant cannot be evicted during winter months. My landlord foreclosed on our property and we offered the bank to buy out his loan amount and they declined. We have a family with little kids and might be facing eviction from the bank anytime now. Can we ask for more time to move out? We also offered them to pay them rent(whatever we were paying the landlord) and they declined. They said they are not in the landlord business, which I can understand. What rights do we have for being Evicted in winter months? I know that it's IL law that a utility company cannot shut down your utilities during winter months(32 degrees or below). Any suggestions?

There is no law that says that landlords can only evict in warm weather. Is so, landlords could potentially be forced to go months without being able to collect rent from their tenants before they could take action.

You can certainly negotiate with the bank that holds the mortgage on the house you're renting, but the bank's only legal obligation to you is to follow the law (i.e., provide you with notice, take you to a hearing, etc.). I would suggest that the best thing that you can do right now is to look for alternate housing.

Did the landlord evict, or was he foreclosed on by his lender?

If the real estate is sold during the tenancy, the tenancy survives the sale and is binding on the new owner, UNLESS the sale was a tax sale or a foreclosure.

From what you say, the unit no longer is a rental unit, due to foreclosure. Therefore, you are not really being evicted as much as displaced, because the unit is no longer a rental.
