View Full Version : How to stop an order to modify child support Illinois

Hi, I am a new member and really need some advice. My ex is taking me to court to lower his child support payments. He does not even pay what he is suppossed to now. I have an order for 100 in cs 50 in back pay and half of daycare which is stipulated in my divorce order. He pays me 100 a week he just started that about 6 months ago. He is not paying the 50 he owes for arreras of 4,000 or half day care which is 100. I know he is working for cash and making money but he told me he has a paycheck stub from his brother making only like 500 a week. He makes much more. What can i do. The last time he told me his rent was 1550 a month and that is his first priority not my son. Please help I cannot support my son on 50 a week thank you soooo much. I have court this monday at the daley center:(

I really wouldn't be too worried about this. HIS priority may be his rent, but the COURT'S priority will be the child support he is not paying as ordered.

My ex tried this several years back...

Have his tax records from the previous year, and all records of current pay "to include cash payments" subpeona'd for the court hearing.

If he doesn't bring legitimate records to court, I believe they can hold him in contempt.

When my lawyer subpeona'd all this, and explained to him how his child support would likely be RAISED if the court modified it, he dropped the case.

They can hold him in more than contempt.

If it is proven that he is getting paid under the table, the IRS will get involved.
