View Full Version : Unannounced(and unexpected) Salary Cut North Carolina

Am employed as a Regional Manager for NC based company
Been with them a touch over 5 years(through both good and not so good times)
Was hired at salary + commission
Have meet sales goals\quota on yearly basis
Have had 1 performance review in those 5 years,last year-scored 8.5ish out of 10(this was the first year the company offered\agreed to them)
Was the West Region Manager up till July this year, when they asked me to transfer back to the South. The South Territory had been vacant for the last 6 months

Received phone call from VP sales on 11/1, that things are tough again and we are facing yet another salary cut. Our salaries(sales force) have been cut in the past(10%) for short periods of time and I had just gotten back to regular level July 1st. I asked him how much this time, and was told close to 50%(he provided a number but was hard to hear on cell phone) but to compensate for this cut I would paid additional commission. I did ask if this were company wide and was informed that it only me. I asked based on what, response was that owner said I was making way too much and that my sales were not as high as the other reps(I was at 155% of goal in the west region as of end of June 07) and at no point in time has our(my) salary been based on sales achievements- that was the commission side of program

My response was one of shock and that I would need to think on this offer. I didn't immediately say it was\is unacceptable as they still owe me roughly 12K in expenses(some back as far as March 07). We ended that call.

I called the VP back the following morning and informed him via voice mail that I would need ANY changes being proposed\discussed to my current compensation plan to be in witting. To date I have not received anything.

The salary cut has taken place as reflected in my last 2 pay checks however no additional commission as been noted and no formal offer has been presented

I put in much much more than 40 hrs\week for this position(weekend trade shows, travel, etc.) and with this "new" plan would barely be making minimum

So,my questions are
1. Do I have any recourse?
2. Can this really be done?(I guess it can as my checks reflect it)
3. other thoughts or input

Yes it can be done as they told you about it verbally. The change need not be in writing. It may or may not be fair but if there are financial difficulties, I wouldn't expect a change of heart.

If you are convinced that you will be compensated commensurate with your worth elsewhere, I'd take dust off the resume and go for it. Sometimes that is the best way to deal with an unfair/undesirable situation.
