WHAT legal thing with booze and tobacco? A little clarification as to your question would make it easier to answer.

Currently, the Federal minimum wage is $5.85. The state minimum wage in South Dakota is also $5.85. Both Federal and SD state minimum wage will go up to $6.55 on July 24, 2008, and again to $7.25 on July 24, 2009.

Don't smoke if you are not 18, don't drink if you are not 21, and don't sell either unless you have the proper permits.

There technically is a separate federal Youth Minimum Wage, at least if the rules are followed.

Check with the state Alcoholic Beverage Commission (or whatever they call it in your state). Generally speaking, if you're too young to do it legally, you're too young to sell it.

Actually, Patty, I get one of my very rare chances to clarify something for you (WOOT!!).

Once 18, several states, including Georgia, allow the issuance of alcohol serving permits that permit underage folks to serve liquor... after being fingerprinted and photographed.

Cigarettes I don't know about... but unless the OP has a permit, odds are she can't sell it.

Oh, WOOT!! yourself, cyjeff. :D

Doesn't seem logical, though, does it?

Are you selling them or serving them?

I think it was part of the compromise when the drinking age was raised. After all, the biggest pool of waiters and waitresses are college students and "actors". If they couldn't serve, it would be really hard to staff restaurants.

If this is a retail store that sells alcohol like bottles of wine or cases of beer, then typically there isn't an age limit. If you object to handling these items, why did you apply to work there knowing they sell them?

If they can't trust you to do your job, why hire you?

That may be their policy, but that doesn't mean it is the law.

I'm sorry about your mother. However, no employer OWES you a job or a certain number of hours.
