View Full Version : Overtime? Banked Hours? Colorado

Hello everyone I was wondering if you could give me some advice...

I currently work for a ski shop / retail industry in Colorado.

Apparently our boss refuses to pay overtime. He says we will get "banked hours" that will be paid at our normal hourly rate... Is this legal? or are we supposed to get paid overtime?

Also, if we do get banked hours how are those to be paid? on the next time card? i'de really like to not get screwed out of my money...

The normal answer would be that only certain governmental employers can "bank" overtime. However, several pointers in your question caught my eye.
- Federal overtime law (FLSA) does not necessarily apply to all employers. Does your employer do $500K in annual sales or interstate commerce?

- Your state may have rules affecting this, but Colorado is not my state, so I will have to defer that to someone else.
