I seem to get pretty good advice everytime I come on here, so I figured I would try again. Here is my situation I have a court order that I am supposed to receive CS Payments on the 1st and the 15th of each month. The payments are to come directly out of his check. The company he works for takes the money but don't seem to like to send it out. I have called the CS probation dept. many times in the past three months and have not really gotten anywhere. It seems the employer gets the benefit of the doubt way too often. When I call, the customer service people call the employer and they are told that they will be sending out a payment later in the week,which usually doesn't happen. ( this has been going on since early October) Finally at the end of November I received two out of the three late payments that was due to me. Payments are still two behind with a third payment that will be late on the 15th. ( As you can see I have no faith that I will get anything before then) CS Probation called the employer again earlier this week and was told by the bookkeeper that she needed to speak to her boss ( which makes no sense to me). They called again yesterday and left a message for the woman to call them back, I called this morning and was told that I needed to wait for his company to return the call, and was told that they also left my ex a message that he still has not returned. I decided to call Trenton ( which is where the main office is) and got the same response. Why is it that the employer takes the money from his check on time and has a problem sending it out and is allowed to do so. When I call I feel as if I am the one doing something wrong, God Forbid you tell these people that you need your money because the holidays are coming and you need to pay bills and feed and clothe your children. I do work full time but have a hard time making ends meet without my CS.
I was also told that the company was sent a non compliance notice 4 times already, Big deal obvisouly it doesn't make a difference to the employer. I cannot even file an enforcement for CS Payments because he is not paying directly. Any info or help would be appreciated.

Have your lawyer send the company president, your ex, the bookkeeper and her/his boss a letter stating that their bookkeeping is interfering with a court ordered judgement. Failure to produce funds at appropriate times can and will result in any and all available remedies levied against the company in total and themselves as individuals until the situation is properly resolved.

You will never again get a late payment.

Do you know how I can go about doing this without an attorney. I cannot afford mine, there is a charge for everything. Since they take it from his check can I do this without an attorney.

Have you tried the CS Probation dept to issue a bench warrant or enforcement hearing? Since support payments are the ex's reponsibility, a little pressure and the threat of jail time, may make ex check with their own empolyer instead of you.

Oh, if you live in Sussex or Morris counties have you seen the papers lately?

Actually had one of my ex's go out of business having collected more than 1100 to go towards my order and neither of us has seen a dime. They told him he would have to go to small claims court to recoup the money but they kept avoiding being served so it was dismissed without prejudice (meaning he could refile). Nice.
