Hello,

I am a full time employee year round. I will be laid off for the winter as sales are slow. I would like to claim unemployment, but here's my catch..
I also have my own business. It is not a huge business, and when I file my taxes, I have not been showing a profit (because I haven't made one yet LOL!)

My income comes from my full time position. The home based business is more of a hobby..and I do file it on my personal tax return, but no income is shown due to expenses.

Can I file for Unemployment even though I have a home based business?

You can file. The state will decide if you still qualify.

In my state, which is not NJ, it is the number of hours per week that you work at the home based business which will determine your qualification.

I'm also in NJ .. that makes sense. I basically work a maximum of 1 - 2 hours per week. So I'll keep that in mind... thank you! :)

I said I was NOT in NJ. But I can't imagine that only 1-2 hours a week would disqualify you.
