Is this fraud and what can we do about it ?? Indiana
Let me tell you our story and I would like to know what you think. We live in Jeffersonville, Indiana and we started looking for a house to rent in March of 2007 because we had outgrown our apartment and needed more room. Like I said we were looking to rent a house and came across what at the time seemed like a really good deal, we saw an ad placed on Schuler Bauer's web site for a three bedroom house with a walkout basement, the ad stated the seller would consider a contract, we then contacted Schuler Bauer real estate agency and looked at the house and then contacted the owners Gina and John . Gina is a licensed real estate agent in Indiana and Kentucky and her husband John is a mortage broker. At the time we were not in a position to get financing so we went ahead and did a contract which locked the price in at 145.000 for a year. We gave them 5000.00 down and the first payment of 975.00. They were supposed to leave some items that were in the original contract like the kitchen table, a pair of corner cabinets and so on, none of those were left they took them when they moved out. We obtained posession of the house on May 22nd 2007 and moved in May 23rd 2007, three weeks after moving into our new home a Clark County Sheriff's deputy knocks on the door looking for Gina and John, and informed us that the house was in foreclosure, we were stunned and in shock. After hiring a lawyer and spending more of our money we fineally settled on a new contract where we would make our payments payable to Litton Loan service until there payments were caught up and then we would make payments out to them. This past Wednesday we were supposed to close on the house, we had finally gotten our loan approved, we went out and purchased home owners insurance and then we get a call from Ken our agent at and he informs us that Gina and John have four leans on the house that must be paid off or settled before the house can be sold, John admitted to having known about 2 of the leans, I was outraged !! My question is , Is there any way that we can go after them for fraud, can we have her real estate license revoked, and how do we go about getting compensation for this mess, they never told us about the leans, or of a possible foreclosure .I refuse to give these people any more money...What should our next step be ? ..Thank you very much for reading this and for your time...Mindy
