View Full Version : TO BREAK A LEASE New Hampshire

We leased a beach house for nine months on Sept.15.The house was just remodeled,so we thought that we found Paradise.Shortly after,we started to smell sewage,and my wife developed a bad reaction around her eyes.The landlord sent a repair man who found the new plumbing in total violation of the codes(no traps on sinks,showers,laundry). He fixed what he saw,but the smell continued.After nearly 2 moths of "band aid" repairs the sewer gas continued
and my wife's Dermatitis did not improve.A new contractor repaired more leaks,
but some smell remains, and a mold test proved positive.Now the Winter wind
blows through the house,and I am using 3 times the normal heating fuel.
With this in mind,I complained to the landlord(verbally)a moth ago,he didn't
react,so I sent him a TWO WEEK notice terminating the lease.I wrote that my
wife's condition is not improving(mold,sewer?),and for nearly $4000/month
we shouldn't have to endure such hardships.
Can he sue me for the balance of the lease,or keep my security deposit?

He can sue you - no doubt about it! The real question is will he win. New Hampshire law mandates that a landlord is responsible for providing his or her tenants with a safe and sanitary dwelling. Failure to do so may be just grounds for breaking your lease - but this will turn on the individual facts and circumstances of your situation.
