View Full Version : How to break lease? Pennsylvania

So I have been having hot water problems, and it has made me late for work several times. It has done it 3 times this week, and 6 times in the last 3 weeks.I live in a high rise, and am trying to get out of my lease through a private owner (not a condo association). It could have my job at risk if I am late because of this more. Can I get out of this lease? :confused:

Thats for you and your Landlord to work out. Have you reported the problem to Landlord? What was his/her reply. Do you have documentation? does your lease say who the responsilbe party is for this?

I am not responsible for fixing anything in the rental. We have maintenance on site in the building, but it has been 4 weeks and it is still not fixed. So maybe I just need to take it up with the landlord? Any feedback is wonderful and I thank you for.

If you have not talked to Landlord regarding repairs yet then that is step one. Note the date you do so.

I have talked to the landlord, as well as the maintenance people and the front desk. So I am beyond step 1, just don't know what my legal rights are. Are they able to sue me for ending the lease early?

Yes if you leave before lease expires you are in breach and can be sued. How many attempts to get Landlord to fix this have you made and when? I am unsure of your states Law so see an Attorney but you may be able to fix it yourself and deduct cost from rent. However you must give the Landlord reasonable time to fix it. This is why you need documentation on when you contacted maint and Landlord. Any paperwork, emails etc you might have will help and you should save

I dont think I am allowed to fix things myself. It is a high rise building, so I believe all of that is on maintenance or the land lord. It has been about a month and it is still going on. I have contacted maintenance/front desk every time it has happened. My landlord said to contact them, that there was nothing he could do about it.

I will take your advice and try to contact an attorney. Thank you very much for your quick replies!

Just wanted to update my situation...

"WARRANTY OF HABITABILITY

Question: What is the implied warranty of habitability?
Answer: The implied warranty of habitability has developed over the years from a number of court rulings that residential landlords have an obligation to provide the basic needs of human habitation including running water, hot water, heat in winter, free from vermin, reasonably weatherproof and free from defects or conditions that would unreasonably subject residents to a risk of harm to them and their property.

Question: What are tenant remedies for breach of implied warranty of habitability?
Answer: After the tenant has notified the landlord of the condition and given landlord a chance to cure, the tenant can 1) terminate the lease, 2) repair the defect and deduct the cost of repair from the rent, 3) sue the landlord for damages, 4) seek a court order requiring the landlord to make repairs or 5) withhold rent and place it in escrow."

Ok now when was Landlord told and how much time has passed? Last effort mihgt be to show this to your Landlord

It has been 4 weeks since I first brought this up. 4 weeks seems long enough for a fix to me.

You waited how long after that to tell Landlord?

If its only been a couple week s since then some "may" feel not enough time has passed. Have you made more than one contact with Landlord and Maint over issue? Talking to Landlord again with information you posted might help

Well I waited about 2 weeks to tell the landlord, because I knew he was going to just push it off to the maintenance staff. He, and his wife, won't fix things. They make the maint. people do all repairs. So I just usually go to maint. to take care of things. I will give it a little longer, maybe a weeka t the most. Then I am going to look at taking it further.
