View Full Version : Legally file written verbal agreement w/o court?? Virginia

I have kind of an odd situation.
I had a child with my long term boyfriend and moved to his state to be with him while he finished his undergrad. He decided to move away from here [9hrs away[ to go to grad school and only told me 2 months before he left. When i moved in with him i was also moving in with his parents bc thats where he lived. now i am still here and working on moving out to my own place. but in order to do that completely i will be filing for child support. he has made a verbal agreement that he would never try to take our daughter from me-which for the moment i know to be true bc he cant balance grad school and being a full time dad... but in 5 yrs that could all change and i want to make sure whenever that time comes around he can not just up and change his mind. is there a way to file documents stating the verbal agreement bw us without actually having to go through the court process??

To make any document stick, it has to be validated in court.

You don't have to use lawyers, but you do have to put it in front of a judge.

....in proper form.

Get the forms from the clerk of court, fill them out, sign them (both of you), have them notarized and file them with the court so a judge can sign off on them.

do i [or him] need to actually go before the judge? or i just need to submit the papers properly and wait and see what happens..and hopefully it will be taken care of from there?
[with my luck..even if that is the case SOMETHING will come up to put a hiccup in the plans] :)
but its good info to know. its better i know how it works before throwing myself into it.

Usually, this is the role of the attorney. Since you are not using one, you will have to do it.

Don't worry. Judges are not 3 meters tall and mean. Most are very intelligent people that chose the duties you are asking them to perform.
