i have a couple of questions, and need help...please.
i'm am pregnant and the babys father is in our country illegally...what are my rights if any???
do i have to list the babys father on the birth certificate?
can the babys father leave the country with my baby?? i hope he wouldn't but its a major stress factor in my life right now.
i am in new jersey and am unsure of the laws...please help, i'm desperate.

You cannot list him on the BC without either a signed (and notarized) affidavit of paternity or he is established as the legal father via DNA testing.
No, he will not be able to take the baby out of the country without your consent.
His legal status has no bearing on his right to establish paternity, his right to file for custody/visitation and the responsibility to help support the child.

thank you so much for your speedy response...
i'm just so scared that hes gonna leave the country with my baby...he snuck into this country, i can easily see him sneaking out with my baby...
is there anything i can do that can prevent him from leaving??
i don't think there are any laws to protect me from him sneaking back...

call INS.
If he is in the country illegally, you are well within your rights to report it, father of your child or not.
