Hello,

I am a divorced father of 2, my son (11) and daughter (7). We have joint custody and I have primary of my son, and she has primary of our daughter. The divorce was settled in may 2006. The kids currently attend the elementary school that I am zoned for (which is also a charter school and has the best average rank in the county over the last 6 years) but my ex (super drama queen and very very vengeful and spiteful) wants to transfer them to a school that is 25 miles from my house and about 15 miles from her house. Her reason for this is that my son told her that some mexican kids cussed at him on the playground, and that he has 2 referals this year (one of which happened when half the class got one during a fire drill). She has already had my daughter's teacher changed because the other teacher yelled at my daugher and made her cry. In short, she always blows situations way out of proportion.

The divorce settlement does not designate schools, or a specific education parent, so I am wondering what her rights are as far as transfering the chilren without my approval. She states that she can move our daughter without my approval because she has primary custody, but is this true?!? She does not even live in the zone of the school that she wants to send them to. Please help!!


I read some other threads on here, and there is a lot of other stuff that has happened that is to long to go into here, but I think that if she tries to move them I am going to file for an emergency hearing for custody.

This situation probably has more to do with the county's school districting policies than family law.

Contact the school board, explain the situation to see if it's even possible to transfer out of the district.

I don't know what county you're in, but most counties have distrcting boundries, if the child does not live in the district, the child cannot attend school in that district.

I truly doubt that a trnasfer to a school that far away will even be allowed by the county.
