View Full Version : Wrongful Termination Time Frame Arizona

A year and a half ago, I was fired from my job for something. Another person was doing the exact same thing, but the owner was not aware of it. He has now became aware of it. Is he required to fire that person as well due to precedent? If he does not, am I able to fire a wrongful termination suit against him?? Even though it has been a year & half.

A wrongful termination means that the employer is prohibited by law from firing an employee for the reason they did. It has nothing to do with whether or not another employee is or is not terminated for the same thing.

Just because you were terminated for reason x doesn't mean that the employer is legally required to terminate every other person who does x. Unless you have a valid and supportable reason to believe that you were terminated and the other person wasn't BECAUSE OF your race, religion, national origin or other protected characteristic, nothing you have posted gives you a claim of wrongful termination.

Thank you for the answer. Although I am black and over 40, I do not believe that is specifically why I was fired. The owner took personal offense to something I was doing, and felt like I betrayed him personally because he is a very selfish and controlling owner. Although I did not break any law or company policy, he fired me because he felt that I betrayed him. Another employee was doing the same thing, although he was not aware at the time. Since he has become aware, he doesn't have to fire him?

As a salesperson, I took kickbacks from a vendor. There is no company policy stating that I cannot. Another exec in the company was doing the same thing. The owner just recieved a letter from the vendor stating that this other exec was taking kickbacks as well. Even though he chose to fire me, based on that, can he chose not to fire this other exec for doing the exact same thing? He made a HUGE deal to all the employees as to exactly why I was fired.

Besides it being ethically wrong, isn't there something I can do??

NO. He does NOT have to fire him. There is no law in any state that says if you fire one person for something you have to fire everyone who commits the same offense. He CAN choose to fire you and not someone else who commits the same offense. The circumstances are not necessarily exactly the same; he is not bound by any law to treat all instance exactly the same.

NO. There is nothing you can do.
