I was told in Mid October that my position was being dissolved and I would be laid off. I was told it was not performance related, just a lack of need of my role due to business needs. An executive from another state, who is not even my supervisor, gave me the news and indicated that instead of severance, I could 4-6 weeks to find another job and if I needed longer, they "could work with me". I was assured that the HR Manager would help me get in touch with an outplacement firm (which she did not even make an attempt to assist until week 5; to find out the supposed "outplacement" is just a company that makes pointers on a person's resume).
When asking the HR Manager if they would work with me being the holidays are coming up and I am budgeted for the full year, she said the executive told her, "they would cross that bridge if they had to". The HR Manager supposedly spoke to my immediate supervisor (who has washed her hands clean of this) and informed me my supervisor would have to speak with the executive.
To make a long story shrt, I have exhausted my six weeks, I have not been able to find a new job and I do not know if I still have my existing job come Monday. I know AZ is an at will state but since it is a lay off and not a performance based termination, do I have any rights? Things like... Are they required to put this in writing? Since a verbal agreement was made between the executive and I (even though he told the HR Manager a slightly different version), are they bound to the promise? Are they supposed to give me a two week written notice? To date, none of this has been put in writing from the company.
