Has paternity been LEGALLY established? I will assume that there is no actual court orders, as you have been living together, so with that in mind you need to file for custody with a petition to return the child to the state. If your are not the LEGAL father you would also have to file for paternity. Hopefully you know where mom is so that she can be served.
Do you know why mom left? Was there anything precipitating the move?

Yes a DNA test was done in order to establish paternity so that she could get child support. At that time we were not living together however later on we decided to live together as room mates in order to both raise our child. we were doing that untill tuesday when i came home from work to find the house cleared out and a note on the fridge. we never did go to court to work out visitation or custody as i thought the living together took care of all that now i dont know what to do first

Go to the county family court and ask for the forms for petitioning for the return of the child and for a motion for custody( you might be able to fine them on-line). If you can afford an attorney, hire one. Today.
