I'm in retail and work for an hourly rate plus commission. Our commissions are monthly but lag 3 months. So I'll get my August comm. this month.
My question is, if I decide to leave, after giving 2 weeks notice or I am fired or the store closes, which is the more likely senario, am I not still entitled to that commission? And if so, do I have to wait the 3 months or would my former employer be obligated to pay me in a timely manner for all commissions owed me.
On the same note, I took a one week vacation in August, I've been there 1 year, but because I took an "un-authorized" vacation, my employer said he wouldn't pay me for it this year. He'd pay me in Feb. or Mar. of 2008. Can he hold my vacation pay from me? Vacation and health benefits were part of the agreement of my hiring last year. The reason my vaction was "un-authorized" was because he thought we'd be short handed for that week. We were not and he had 1 months notice.
