We had a one year lease agreement with our tenants. We are under the assumption that they still should give us 1 months notice to move out!!
Their lease was up 10/31-07 and we spoke to one of the parties on 11/6 to find out what was going on if they were planning on staying on a month to month basis and where the rent was. We were told that they really wanted to stay on for much longer and maybe try to buy the property of of us. We were told that bacause of financial hardship we would not get the rent money till 11/9. When we called them about the money on 11/9 the wife told us that she had moved out and that her and her husband were to split up and she did not know if he still lived there. She wanted her security deposit to go towards the last extra month rent and I told her that that is not agreeable and that I regardless still need month notice!!
We have been driving by the property ever since and posted notices on the door and it looks like no one is coming or going. When can we take possession of the property. We can see through a window that there are still furniture in there. We desperately need to get in there and get it ready to rent out again bacause we can't afford to hold another mortgage. We have 2 other properties in eviction status. Please let us know what we should do. We have not received any rent and can't get a hold of the other party.
