I am planning on submitting my resignation next week effective 12/28/2007. This will give about 5 weeks notice and my employer only requires 2. I have 6 unused vacation days remaining which I assume will all be accrued on 12/28.

Is my employer required to compensate me for my unused vacation days?

My concern here is that we have a "use-it-or-lose-it" policy.

New York requires the payout of unused vacation time UNLESS there is a policy to the contrary.

If the company has a written policy that they will not pay it out, the state of NY will not require them to.
