View Full Version : Pay owed to me after being let go New Jersey

Ok..here is my story. I was working for a small company for 7 years starting on my 8th. I started seeing resumes around the office and did some research to find that my position was being posted on Craigslist. When i inquired about it, the owner told me that they were going in another direction. My skills were no longer up to par...blah blah blah. She told me she wasn't going to throw me under the bus and was going to give me ample time to find employment. During our conversation i asked her "Well how much time do i have?" she told me well the new quarter starts OCT 1 so i will give you 2 weeks...threw me under the train instead. She said she wanted a smooth transition and because that last day was on a pay week and i had 1 week vaction left, then when i left 2 weeks later i would get a full check. When that 2nd week came never got the 2nd week. Called about it and she said that Paychex had me down as using 144 hrs of vacation so she only owed me 2 days...on paychex stubs, it says that i used only 120 hrs. During the next pay period she paid me for 2 days and all of a sudden it said i had 160 hrs. No one will give me an explanation. She also owes me for out of pocket expenses not paid. I have heard that there may also be in leiu of notice pay as well. Am i entitled to that? I should have had 7 weeks notice instead of 2...can anyone please help with some answers or direction.

On what are you basing the statement that you should have received seven weeks notice? That's not required by law. In fact, notice of any kind is not required by law except in WARN situations, which this is not. Do you have a contract that states that?

Not really basing this on anything, just heard that and was wondering if in fact that was true. Other than that what about money that is still owed to me? do i go to the labor board?

Nope,I don't think thats true. If you feel you are owed wages, you should contact your states version of The Department Of Labor, and ask that they check into it. If they find they owe you, they will help you get it. Good luck!

The state of NJ does not require the payout of unused vacation. If there are wages owed you for time you actually worked, you can file a complaint with the state DOL. They do not owe you unused vacation under the law, and they do not owe you for any notice time that was not worked.

The above presumes that no contract or CBA specifically says otherwise.

As stated above, no notice is required by law except in situations covered under WARN or a state version thereof, which is not the case here.
