A friend of mine was injured at work. She was on comp for more than five months and got behind on her bills. When she went back to work, she requested to cash in 200 hours of pto time that she had accrued.

She was told that she would only be reimbursed 75% of the value of her pto time if she cashed it in. She would receive 100% however if she quit or was terminated.

She did cash in her pto time and received 75% of the cash value because she was desperate. She is a nurses aid in a nursing facility. Is this legal?

Yes, that is legal in West Virginia. The employer didn't have to allow her to cash in any PTO at all.
