I have a tenant who caused some damage in the house, but we would prefer to walk away with the security deposit which will cover 1.5 mon of the 2 mon unpaid rent as opposed to going through the effort to go to court, etc. I would like to contact the former tenant (moved out 1 week ago) to ask him if he would be willing to sign a dual release letter where we would release him of all damages and just keep the remaining sec dep to cover unpaid rent and then release him of any additional unpaid rent/fees, etc. The other end of the release would be him releasing us of any liabilities pertaining to the house (if there were any injuries, etc for which they might try to sue). First off, is this possible in a legal sense or will the document not hold up? Also, am I violating any laws contacting him via email or phone to discuss his interest in signing such a document before sending it out?
