We 4 siblings are trying to sell to 1 brother the home our father owned. He died without leaving a will. We already have an affidavit of heirship on file and the county said we each need to sign a general warranty deed to our brother but he needs the title in his name in order to get the loan to buy us out. Can we just do a seperate promisary note for the money we agree to sell our share for and still give him the general warranty deed free and clear so he can get the loan. Also the 4 grantor siblings are in 3 different states and the brother we want to sell to is in another state. Can we sign the general warranty deed in our various home states in front of a notary public and then send it to him to sign as grantee in his home state in front of his notary public? Thanks for any info you can provide. None of us have any upfront money to speak to a lawyer or we would be glad to do it.
