Recently, my husband was terminated from his job of 11 years. He has no history of any wrong-doing and has NEVER received any written warnings of any kind during his employment. On his last day of work, he parked in the owner's parking spot as it was the only one available and he was in a rush to get out on the road. When he returned, the owner was angry and confronted him. The owner then became loud, yelling at him, and my husband also yelled back. During the argument, he was asked not to come back. He used no vulgar or offensive language, but does admit he yelled back.
His denial of benefits was for "misconduct not in the best interest of the employer."
Could his excellent employment history and the fact that the employer has no documentation, win him his appeal? He is still in shock that he was even fired in the first place, it was more a decision based in the passion of the moment than in any real wrong-doing.
Please help...we have been 7 weeks with no income and have 2 children. We really need to win this appeal. Any advice would be appreciated.
