View Full Version : Landlord selling the house I live in, Massachusetts

I currently live in an apartment in a three family home. My landlord recently informed me that he is selling the house. Obviously the landlord needs to have potential buyers look at the house and in my apartment to see it. My questions are:

1. Does my landlord have to give me any notice before he or the realtor brings people over to see the apartment?

2. If he does need to give me notice, how much in advance?

3. Is he allowed to show the apartment while I am at work and nobody is home?

4. If he is allowed to show it, does he need to call me to get my permission or can he not even tell me he was ever there?

5. If he is not allowed to do some/any of the above, what can I do?

Its my belief its 24 hours notice but laws vary by state. I would plac eyour focus on finding new digs rather than worry about we sees home. I was in a similar situation here in CA although I lived in a single family home and the home itself was up for sale. I was told (never saw a Law) that 24 hours notice was required. My landlord complied with that but I also told Landlord I was not going to go out of my way to make sure thngs were presentable as I would need to start packing and planning my move.

My husband and I rent homes and the lease agreement states that we have to give the renter 24 hours notice, before we show the home. They have the option of being there or not. The only time we have had a problem, is when they live in filth and don't want us to see it. Look at your rent agreement, it may spell this subject out in black in white. Talk with the homeowner. If you haven't had any problems with him until now, you might be surprised what he will agree to.

In my lease it says that he can enter after giving "reasonable notice," but that he does have to give notice. I recently went through this, with some real DB landlords, and I'm glad my father's retired. They would give me 20 minutes notice while I was at work, and they told me it was for property managers, not a sale, so I had my dad babysit. I only did that because I didn't trust them as individuals, let alone landlords.

I don't blame you for having someone there when the home is shown. You never know what some Landlords will do, once the prospective buyer has left. Not saying all landlords are going through your things, but it can happen.
