Jut a question about a new policey at work. Starting now if you call in sick you will be charged vacation or eto(earn time off) and you have no say in it you will also be charged a point. The points are on a system they use to get rid of people who call in a lot at 10 your gone. I was just wondering is it legal for them to force me to take vacation for a sick day and not let me choose when my vacation will be taken. They say unpaid vacation will be availible but rare so if your out your out.

In all 50 states the policy you describe is legal.

Federal and state laws do not require employees get sick leave, vacation or holidays.

The combination of all three, commonly called PTO, is not required by law.

If you call in sick and have PTO available, the employer can take some of your PTO to keep your pay at the normal level. They do not HAVE to do that. They may. You can ask that they pay you less than normal. They don't have to do that, either. (there are good reasons to refuse).
