I am living in the house with 3 roomates where all three of our names are on the lease. Unfortuently one of the roomates has decided to bring in a fourth party, whome myself and the second roomate do not agree with. This person is living here, and has been living here for free. Also, when the third roomate that brought her in here leaves the house to go to work...she is still here. We cannot deal with this any longer. If we were to call the authorities, would they side with us and tell her to leave if the other roomate is not home? Her name is not on the lease, she is simply a guest that never leaves.

The authorities likely cannot do anything, as the other roommate gave her permission to be there. However, the LL should be interested in this new development, especially if your lease addresses other people living there.

Look at your rental agreement. It should specifically state that only the people who have signed the lease should live in the home. You may be risking eviction, if it is proven you have more people taking up residence in the home than the contract allows.

Also look at the zoning. Some areas prohibit more than 3 unrelated persons in the same house.

As a frame of reference, my lease says that I may have guests overnight for short periods as follows: unrelated guests for a maximum of 1 week in any 12 month period, and related guests for a maximum of 15 days in any 12 month period. I had my boyfriend added as an additional occupant so that he was exempt from that 1-week thing, even though he doesn't live there.
