View Full Version : Delaware Steel Toe Shoe requirements

My job is staring to require steel toe shoes. Since this is not regular attire. Does DE state law require me to pay for them or must my employer pay for them. Any job that hs ever required themhas always provided them. So am no sure what to do. This is a large company with many employees and we are not sure what the law requires. Thanks Scott

The Delaware website did not turn up anything regarding paying for required safety equipment when I searched there for "uniforms".

Federal law does not require the employer to pay for required uniforms; it only provides that, if the employee must pay, the deduction from pay cannot take the employee below minimum wage.

Try calling the state DOL.

Thank you, I have contacted the Wilmington office and it is a Employment at will State and if they require it then you can either pay for it your self or quit. The only way they are required to pay, is if your purchasing them would put you under minimum wage. Again thanks. Scott

Well, employment at will really has nothing to do with it, but that confirms that Delaware has no laws regarding this issue; therefore the federal laws apply.
