View Full Version : Want to break the lease Tennessee

Hi All,
We just moved to Nashville, TN, and rented a duplex and signed the lease for 8 months. Unfortunately from the first day onwards, we were having one problem or the other. When we entered the apt we found the rooms were not cleaned at all and had full of dusts. We spent 4-5 hours in that night to clean the floors.

The next problem was blocking of kitchen sink within 24 hrs of moving in to the apt. When we complained to the landlord (rather landlady) about the problems, she tried to fix herself, but did not work out well.

Last week, we had another problem, the water blockade in the bathtub. I tried whether the lever (one normally sees in the bath tubs in US) was filled position or in empty position. But in both ways, the water did not drained off.

Later we called the landlady and she said she will send the plumber next day late afternoon or evening (means after 24 hrs). But having a child of less than 2 years, I told her that, it needs to be prepared at the earliest. I was also angry with her because three days back she sand-papered the door (it was not closing) and bedroom had a lot of fine saw dust. She did not bother to remove/clean the floors. So we ourselves had to clean the floors.

Anyway, after my talking, she brought the plumber on the same evening (we were not there at that time) and she said he checked the bathtub and found the lever was in upright position (in filled position). As soon as he put that one in empty position, the entire water drained off.

We do not know whether the plumber said was correct or not. I tried both the ways earlier (thought that my child might have played with that). But since he was not well (got allergy from the saw dust) we did not give him shower at all.

Anyway, now she demands that we pay the plumber fee. And 3 weeks after signing the lease, she has given us a list of "rules and regulations" which we have to sign and have to given to her. I do not know why she gave me the rules and regulation now, not at the time of signing the lease! In the rules and regulations, we have to pay for the maintenance, pest control service, etc, etc, which were not in the original lease.

Now we are really fed up with her and do not have any mental peace since we moved in. This is really hampering our research works (we are research students). So we are considering to break the lease and move to another apt/place.

I would be really grateful if some of you can advice us what we should do and if possible, how to break the lease and how to get back the security deposit.

Just think of the hassles you'll have if you break the lease considering she is giving you other hassles.

You are not required to sign any new paperwork, whatever you signed in the lease is what you agreed to and you are not required to accept any changes to that contract. I assume she also signed the lease? You then have a valid contract to hold her to as well. Be sure your lease does not contain a statement such as renter will sign and accept our rules and regulations document that may be provided separately or you may have to sign the other additions.

Unless the apartment is uninhabitable, you really can not break a lease. You would be responsible for the full rent for the full time that the lease is in effect unless someone else rented the unit earlier.

The plumber fees are standard when no problems are found or if issues such as a flushed toy cause the problem.
