Hey there,

I figured that I would come to this forum and ask this question. I have a friend of mine who signed a lease at an apartment complex. During her short time in the complex, there have been bags of trash sitting outside in the hallways, couches out in the halls, bugs flying around every which where, as well as horrible noise (blaring music) until the hours 4:30am during the week not just weekends. This has provided an unhealthy environment for her because she can't sleep and, consequently, is becoming ill because of it.

The lack of cleanliness, noise, and pests issues are a clear violation of their OWN rules that they set for their own tenants. When management has been contacted to register complaints, it has been met with even more negligence. She's to the point now that she doesn't want to live there anymore because the complex has not lived up to their end of the lease. She's also concerned about retribution from the other noisy tenants as well as management for registering complaints. After doing some research, complaints against this complex have been well-documented. Does she have the grounds to get out of her lease? If so, what are the proper actions she should take. I've encouraged her to document everything: noise complaint calls, sanitary calls, sending complaint letters certified, etc.

She has the grounds to call the health department and the police.
