 I am a full time non-management employee at a 24 hours conveniece store. Since this is my first time to work in the retail industry I just wanted to know if my manager has the right to make me work a double shift simultaneouly without prior notice. Here is the situation: When I work the 2nd shift which is 3pm-11pm, and the person replacing me does not show up, I normally call my manager, unfortunately the call is not answered. I would leave a message in voice mail to call the store. Sadly no response until the manager comes in to work in the morning. Normally 6am-7am. I am not allowed to lock up and just leave the store so, I am forced to stay till the manager decides to comes in. Working the 3rd shift which is 11pm-6am. Then back to work again at 3pm is not healthy. Aside from endangering my life, (working alone in a convenient store overnight, the security tapes are not changed. I can't change it because the cabinet is locked. and lack of sleep that makes me weak physically it also impairs my judgement to decide quickly.) I was told by the other associates that it is the manager's responsibility to find a replacement for employees who do not show up. And if there is no replacement it is the manager who has to cover that shift. But this manager refuses to answer the telephone when I call for backup. Also there have been numerous incidents when this manager was made aware that the person replacing me will be late or has called out sick but this manager does not tell me. And just assumes I will stay and cover the shift. Is there a law against this? I am scared to question the manager for fear that I can get fired. I just need to know if this is a common practice and if it is legal. Thanks:confused:

I don't know how common a practice it is, but it is legal.

Bad management, I completely agree, but not illegal.

At some point the only cure for a bad employer is to take a different job with another employer.
