Im writing about my husbands work place.He has been there for 13 years.
There is a place on his pay stub for employee loan.This company has put everything under this title.They never have given us an itemized statement for what he is paying back or how much he owes them.We have not taken out any loans for a long time.They continue to take out 300 dollars a month under employee loan.They will not explain what this is for.They also put 42 dollars into their checks for company truck insurance and then take it back out.Does that mean we are paying taxes on that insurance for their company trucks?Can they do that?Also they did not pay them their regular salary on time.The payroll lady didnt put the direct deposit in on time and it was a holiday weekend.Now our rent is late and the boss didnt even show up for work when this happened.They charge 60 cents per minute if their company cell phones are used for personnal reasons.That is 30 cents a minute over what the cell phone carrier charges.Then if they owe any money out of that cell phone charge they put that under employee loan.Can they get away with these things or can I get any help?Thank you,Terry North Carolina

A number of questions all in one big paragraph, but let me take a shot.

1. NC law requires that all deductions except those required by law be authorized in writing by the employee. He should ask payroll to see the authorization he signed and ask them to give him an accounting of this deduction. If they cannot/will not do so, he can file a claim for improper deductions from pay with the state Dept. of Labor.

2. Truck nsurance? On the company's trucks? Sounds like, yes, he's likely paying taxes on this item, and the way they are doing it is known as "imputed income"; in other words, a "benefit-in kind" provided by the employer that is income. This is NOT a "benefit" to the employer and I can't think of any reason it would be imputed income to the employee.

3. NC law requires that employees be paid "on the regularly scheduled pay day". Problem is that, by the time your hubby would file a claim for late payment, it's likely that payment will have been received, although he can certainly do so, so that the DOL at least will eventually know it occurred. What did the employer say? Will the payment be posted on Monday?

4. Again, the deduction rules apply. However, it sounds like the employer is, in effect, "fining" the employee for using the cell phone for personal calls. Guess the ultimate answer to that is never to use the company phone for personal calls.

Thank you for clearing that up for me.However does this rule apply to all companies including places of 20 employees or less,or local companies?

Yes, it does. NC has no distinction for "small" employers.
