View Full Version : Careless Driving in Mich Need help Michigan

I was in a motorcycle crash about 4 weeks ago. I was in a parking lot when i crashed the bike i went through a fence and into a dumpster that hurt bad.
I broke my collar bone and severely bruised my left leg and ankle. I have no idea what happened I suffered a concussion and i can't remember about 5 mins after the crash. I also have no memory how i crashed, all i remember is pulling into the parking lot and then waking up with the fireman strapping me to the board.
I received a ticket for careless driving. I know me and i wouldn't be driving stupid in a parking lot. I also don't think that anyone witnessed the crash.
Whats my best defense for when i goto court?

I don't know what kind of a defense you can mount. I might find something if I could see the place where it happened, but it's hard to think of a way that a non-moving object could cause an accident. I suppose you might have been trying to avoid some other hazard, like reckless car, and then hit something.

The only defense that comes to my mind would be to research the jurisdiction of the officer to cite people in parking lots. Some states allow it; some states don't; and some states allow it only in certain circumstances.

Is it possible that someone hit you with a car? This could also likely be a crash caused by an unimpacted vehicle or pedestrian. Or your motorcycle could have had a mechanical failure that caused the accident.

It is wrong for the officer to give a ticket when he doesn't know what happened. Too many will do that, assuming that you had to be driving wrong if you got into a crash.
