I will try to keep this as simple as possible. After inspection on my home the buyers requested that I repair certain cosmetic items that were found in the inspection report. Nothing material or structural was found in the inspection report. In order to expedite the process and allow the buyers to have the home repaired to their satisfaction I offered them $1,500 to cover the cost of repairs, which I believe were minor in nature.
The buyers have subsequently not accepted the $1,500 and have indicated they are walking away from the deal. In an effort to try and save the deal. I verbally offered to have everything fixed, but they have refused this as well and have backed out of the contract.
My question is am I entitled to keep their ernest money? I would think so but I get mixed messages from my realtor and the title company. Given that the buyer isn't interested in whether or not I repair the items requested from the inspection report I view this as a breach of contract which I would then be entitled to their ernest money; however, again I am not sure I have sufficient grounds to claim a breach. Any thoughts or comments would be appreciated.
