Hi,

I have come to USA on an H1B work visa via company A which is New Jersey based. Thru A, I was working on a project for another company X in California, for 8 months.
After 8 months, I quit A to take up permanent employment with Company B in California.

I have given 1 day notice.

Company A filed a civil lawsuit against me for quitting before 1.5 years, Misrepresenting that I would stay with them for that period, Breach of contract and claim compensation for damages, lost profits, etc.
No amount is mentioned in the lawsuit.

My queries are
Can an employer sue an employee when the employee quits?
How much am I liable to pay in case the ruling goes against me?

Thnx

1.) If the employee has signed a contract to stay for a specific period of time and breaches that contract, yes.

2.) There is no possible way for us to know that.

And may I suggest you see an immigration/contract attorney ASAP, as this may affect your immigration status as well. You are being sued. This is not a do-it-yourself project.

What kind of Attorneys handle these kind of issues?
Are they Labour and Employment ?
Or are these some other types?

You need someone versed in both contract and immigration law. Contact the nearest chapter of the American Bar Association.
