Hello --
A few weeks ago, my husband and I had an argument, and he went out apartment shopping. He said later that he realized that we don't have the funds to pay for rent and our mortgage. Since then we've "reconciled" and recently I found out that he has a girlfriend. He thinks I don't know. I'm not sure how I'm going to handle the situation yet.
We purchased this house just a few months ago. During the escrow process, I recall signing a paper agreeing that we will wait at least a year before selling. Otherwise, the loan company can make us pay the full loan immediately, or something like that.
So, the girlfriend thing is getting more intense, and I've noticed that my husband has recently placed our escrow paperwork on his desk. Can he get a second loan on our house, to fund rent he'd like to pay, without including me? Or, am I wrong about the law, and we can sell our house so soon, in the event of a divorce, for example? Or, is there some way he can try to kick me out of the house and keep it for himself and his girlfriend? The title is under community property with rights to survivorship. Or something like that.
The majority of his stuff is still in our garage, so it's like he's not moving in and is waiting for some situation to fall into place before he goes on his merry way.
