View Full Version : Voluntary Termination of parental rights with the possibility of adoption by stepdad Indiana

My ex husband and I have been divorced for almost 10 years and he is now talking about voluntarily terminating his parental rights. I am inquiring on whether or not this is possible. My husband of 6 and half years is willing and wants to adopt my two daughters. Can we do this and if so how?

if he is willing to voluntarily terminate and your new husband wants to adopt, it will be fairly simple. I would hire an atty to draw up the paperwork and get it files. Some states require the adoption to be filed with the termination and some want it filed after the termination.

I appreciate the info. I figured that since it is voluntary and my husband wants to adopt then it would be pretty easy. I was just unsure as to whether or not the biological father would be able to get out of his responsibilities that easily. Fine with me though.

he wouldn't if there was not an able and willing person to take on his responsibilities

One thing...

If the ex owes any arrears in child support, those don't go away unless you decide not to pursue them.

This is a huge step... are you sure your children do not want a personal relationship with their bio dad? If your husband adopts, is he ready to care for the children even if you divorce?
