View Full Version : Pay check stub West Virginia

When I went in for my check stub 2 weeks ago ( I have direct deposit) I was told they had lost my check stub and was trying to find it. I went to the bank and saw how much my check was. That is when I noticed that my check is short 7 and a half hours of over time. I have went to HR everyday since and they keep telling me they will get me one and that they are trying to figure out what happened that I was not paid for my overtime. Is there a law that says they have to give me a paystub and how long do they have to make my check right?

There is no specific law that mandates how long an employer has to rectify a paycheck mistake. Have you received the next regularly scheduled check? If not, it may be on that check. If so, and it was not, keep asking.

Unfortunately, I don't have my independent resource that provides the pay stub requirements for each state and the WV DOL website has been so "redesigned" that you can't find anything on it. :( But another source I have at least says that some type of pay document is required by WV law, although the details aren't provided.

WV is not my state and I will defer WV law to Patty or anyone who wants to address that.

I can say that speaking as a long time payroll person, payroll checks and stubs are normally a single part form and employers do not normally have extra copies. In fact the pay stub is normally physically attached to the pay check (or direct deposit advise) unless someone removes it. However, to my knowledge, all payroll systems without exception have something called a "payroll register". In the past it has been quite easy to photocopy the related page, then cut away the parts unrelated to the employee in question from the copy. This is maybe a 5 minute process. The result does not look like a stub, but generally has exactly the same information (except for maybe benefit hour balances). If the employer is a little more sophisticated, it is not difficult to create a standard report which duplicates the paystub.

I am not saying that your employer is legally required to do this (WV is not my state), but I will say that this is a mechanically simply and common process should your employer choose to do so. My last employer had thousands of employees in 20+ states, a 3-person payroll department and we routinely U.S. mailed all pay checks and direct deposit advices. If an employee claimed the paystub was lost, this was our routine response practice.

I am waiting till I get my check this Friday and I will know then if they gave me my overtime due me. I am still waiting on my paystub. I ask everyday for it and am told they are working on it. The company I work for has 3 call centers and almost 280 stores. I am sure they have a way of making me a copy of it.

I think it is very unlikely that they have a copy of your paystub anywhere, and if they use a payroll service such as ADP or Paychex, it is about 100% certain that they do not.

Everywhere I have ever worked has had to use the "payroll register" method described by DAW if employees asked for a duplicate stub. I have NEVER worked anywhere, where copies of the actual stub were available.

I'm sure they can, too. I've worked on many payroll software applications, and they've all had SOME way to recreate the numbers.
