View Full Version : Deducting pay from an exempt employee

Question:
Company X has a “bona fide” paid time off program in which employees accrue both Sick and Vacation time each pay period to be used in the event of an absence from work. An exempt employee that has exhausted their accrued sick and vacation time and is out for part of or an entire day, can the employer deducted the missed time from the employee’s pay.

They cannot deduct your pay for a partial day, but I believe if you miss a full day, they can.

Someone will come along and correct me if I'm wrong.

I'm coming along, but no, Julie, you're not wrong. ;) As a matter of fact, if the partial day absence is due to usage of intermittent FMLA, then even the partial day can be docked if the employee is out of leave time (that's the only situation, though).
