My partner and I recently quit a job in Utah and moved back to Texas. The employer is a real big jerk and we are worried they will "forget" to mail our checks on the date we are supposed to get paid. Is this legal? And if they do "forget" to mail off our check what can we do about it?

Also, we lived on property and we are owed deposit, how long do they have till pay this back to us? It was taken out of our checks.

Since you quit, your final pay is owed on the next regular payday after your last day of work. If it is not recieved, you can file a complaint with the Utah DOL. Allow for mailing time; it need not be RECEIVED by the next regular payday, particularly where you moved out of state.

I'll let one of the payroll people address your second question.

What makes you think he'll refuse to pay you?

Re: your second question, this really isn't an issue addressed by any state or federal wage payment law. Were you required as a condition of employment to live where you did? When you agreed to have the deposit deducted from you pay, what did the agreement say about refunds of deposits? This MAY be an issue of landlord-tenant law, of which I have no knowledge. You might try posting this in the Real Estate forum elsewhere on this site.

As an aside, though, I live in Maryland and, although it's probably a state-by-state issue, I will be moving soon, and the management here told me they have 45 days following my move-out date to refund my deposit.
