I have a friend that works as a waitress at old town buffet. She told me that she gets paid $3.75 an hour and they refuse to pay her the minimun wage claiming that she gets tips. So if she makes $3.75 an hour and $3.00 in tips she is making more than the minimum wage or so they say.
Is this legal? Thanks for your help.

The employee's wage plus tips needs to add up to the minimum wage in any pay period. If not, the employer must make up the difference.
