Hello. I have a question. My daughter's mother and I signed custody of our daughter over to her father and step-mother a few monthes back. (Her and I are not together and I am stationed out of state.)

The grandfather has since filed for child support on me and I am paying 620.00/month, but has not filed on the mother. She does not live in the home with my daughter, and is currently engaged and pregnant with another child. She is in no way supporting my daughter, and hasent seen her since we signed over custody rights.

Is it legal for the grandfather to single out one parent for support, and let the other get out of all responsibility scott free?

Is she recieving welfare benefits?

I think she may receive medical seeing that she is pregnant, but I am not 100% sure. I take it that makes a diffrence?

Yes. If she is recieving assistance (I'm not sure if Medicaid is considered "welfare" for this purpose in PA) then her income is low enough that she cannot adequately support herself, much less the child.

Is there some particular reason why you do not have custody of your child?

I do not have custody because I am active duty infantry, and you cannot be a single father with my job. I have only met my daughter once, she left me when she was pregnant while I was deployed in Iraq. It's hard to see her because of my job, but I do call her and send pictures. She will be 2 in July.

And I made some phone calls, and No, she is not on welfare. They just never filed on her.

Have you contacted CSE to find out why not? It's not right that only ONE parent pays support for a child when that child is not in the care of either parent.

Yea, Im going to do that. Thats why I wanted to know if it was legal for them not to file, so I wouldent sound like an idiot when calling. Thank you for the help.
