My question is that if and employee works overtime that was required to get the job done. can the employer adjust the employee's working schedule to compensate for the hours worked that were overtime? for example employee's schedule is 10 am to 7 pm and works overtime that day and has same schedule the following day but is told to come in an hour later to make up for hours worked over the previous day. the employee is fulltime and guranteed 40 regular hours a week.

The employer may dictate whatever hours it wants.
If the employer cuts hours on one day to avoid extra hours on another within the same work week, that would be legal.

Is the employer trying to not pay you for daily OT or weekly OT. This is Caif. right?

Even in California, it is still legal for the employer to adjust the employee's schedule.
The adjustment may or may not affect the amount of overtime paid since CA has daily overtime, but that does not make it illegal for the hours to be adjusted.

Yes CBG I understand that and I don't dispute that the employer sets the hours nor the legallity of it. Just asked the question if the empolyer is trying to not pay OT as required in CA on a daily rate.

Sorry, BTDT, I wasn't necessarily responding to you; it just came next after yours on the thread. It was intended as more of a generic comment.
