I signed up for short and long term disability benefits with my company by the correct due date. However, when they changed carriers this year they had what they called a "hiccup" in the system and many of us did not get signed up. I was not aware of this until my daughter became ill and I was not able to get these benefits.
When I challenged them stating that I has turned in my documentation by the due date and that they error was on their side, not mine, they responded basiclly that I was SOL because they sent aout notices for employees to check their paychecks for benefit deductions.
I challenged back stating that I did check my pay stubs but, because of the way the deductions are abbreviated and lumped together, I assumed that they were all there and not just some of them. They could care less.
Now I am out several thousand dollars in lost compensation and I am wondering whether I have any legal recourse here. If the error is on their part are they not required to at least make a good faith effort to fix it? And shouldn't the responisibilty for scru bbing the records and verifying correct deductions be on the part of the "expert" or the Human Resources/Benefits departments?
